A judge has denied an injunction to prevent the Watauga County Board of Education from purchasing property for the new school in Valle Crucis.

The Watauga Democrat reports the motion for the preliminary injunction was filed October 10th and Superior Court Judge Susan Bray ruled on the injunction October 29th.

The plaintiffs, Deschamps Holdings LLC, the Deschamps family and The Mast Farm Inn, owned by the Deschamps, filed suit against the Board of Education and sought to prevent the board's purchase of a 14 acre tract known as the Hodges property for use as a new school site. The property is adjacent to The Mast Farm Inn.

According to the report, attorneys for the plaintiffs say the litigation against the school board will continue. Attorneys for the school board say the General Assembly gave local school boards authority to determine the suitability of school property and due diligence has been conducted to determine the site's suitability. Judge Bray has not filed a final order in the lawsuit, and the due diligence period continues through November 15th.

The Watauga County Board of Education will meet at 6 pm. Thursday evening at the Watauga County Schools Central Office at 175 Pioneer Trail in Boone.
