A temporary restraining order has been granted by Superior Court Judge R. Gregory Horne blocking the Town of Boone's extension of the 14 day isolation extension that's part of its amended State of Emergency, approved by the council Thursday.
The temporary restraining order was filed by local attorney Nathan Miller on behalf of Anne-Marie Yates, Mountain Resort Management LLC doing business as Holiday Inn Express of Boone, Hospitality Group of Hickory Inc., and Smokey Mountain Hospitaliy LLC. The TRO states that the inability of the Plaintiffs to run its business has the potential for immediate harm to their reputation by being unable to honor previously made reservations. The order was granted by Judge Horne, restraining the defendants, The Town of Boone, from enforcing that aspect of the amended State of Emergency. The TRO applies only to the 14 day isolation. All other aspects of the town's amended order are still in place and are subject to the enforcement guidelines listed. The restraining order was filed Friday afternoon and the Preliminary Injunction hearing is set for June 1.
