Round Three to Templeton Properties PDF Print

The latest—the third—round in the case of Phil Templeton and Templeton Properties verses the Town of Boone over a property proposed to be used to build a medical clinic has gone to Templeton.  Friday, Superior Court Judge Shannon Joseph reversed a decision by the Boone Board of Adjustments in which a special use permit was denied. The decision was handed down Friday after a June 24th hearing on the much-appealed matter. The Templetons reported that they had received the notice from Joseph by email Friday, but as of late Friday afternoon, the ruling had not yet been filed in the Watauga County Clerk of Court's office.  The matter started six years ago when the Boone Board of Adjustment denied a special use permit request for a clinic at 315 State Farm Road. That May 2007decision cited that the development was ‘not in harmony with the adjacent neighborhood and incompatible with the town's Comprehensive Plan.’ The latest ruling is that the BOA's findings did not support that finding. She also said that the board's citation of general policy statements from the town's Comprehensive Plan were insufficient in denying the permit.
