Two Tennessee fugitives and a third man were taken into custody Monday near Boone Mall. Monday, Boone Police were alerted to be on the lookout for a vehicle involved in a breaking and entering in Watauga County, and soon found the suspects behind the Boone Mall. Michael Jason Tolley, age 33 of Fort Campbell Kentucky, and Brittney Danielle Hutchins, age 22 of Elizabethton, were taken into custody on fugitive warrants issued in Tennessee. Both were taken to the Watauga County magistrate and were held on $50,000 secured bonds and given April 5, 2011 court dates.  Investigation into their involvement in the initially reported break in is ongoing and charges are expected. Another occupant of the vehicle, Andrew Jeremiah Smith was detained and further investigation has led to the arrest of Smith, age 28 of Elk Park, on one count each of felony breaking and entering, felony larceny, and misdemeanor possession of stolen goods.  The charges stem from the East Cove Lane incident and an additional break-in that had just occurred at App South Apartments in Boone. Smith was taken before a Watauga County magistrate and held under a $5,000 secured bond after being given an April 6, 2011 court date.  Additional charges are forthcoming and additional incidents are being investigated.
