Templeton vs Boone Returns for Rematch PDF Print

The State Court of Appeals has sent back to Boone for yet another proceeding in the ongoing dispute between the Town of Boone and Templeton Properties over the denial of permission to construct a medical clinic on State Farm Road.  The dispute, now in its fifth year, has been in court and the denial was appealed to the NC Court of Appeals where it landed in 2010 with an order to have the town adopt an explanation for the denial.  In that hearing, in which Templeton attorneys made their case—again—the town allowed the public to speak, a point that lead to yet another appeal, with the appeals court saying that was improper procedure.  In the town release on the matter, Boone Town Manager Greg Young defended the action of allowing the public to speak, but pointed out that the Appeals Court did not rule on the merits of the case—only the process—but he said that the town will comply with the latest court order and—once again—hold a session with Templeton attorneys to present their case.  The 10,000 square foot medical clinic is proposed for a State Farm lot near the VFW, an area the town maintains is a residential area, and saying that access to the site is troublesome.
