Village of Sugar Mountain to appeal annexation decision PDF Print

Last month, Judge James Downs decided the Village of Sugar Mountain’s annexation of surrounding properties was illegal. This month, the village council has decided to file an appeal. 

Mayor Dennis Lacey announced the decision after the council returned from closed session yesterday.

The announcement was as follows


 "On behalf of the Village of Sugar Mountain, we are disappointed in the recent ruling in this annexation case. We believe that the judgment contained many conclusions which are contrary to the evidence presented at trial and contrary to the manner in which the village conducted this annexation process. Throughout this annexation process we have acted in good faith and in the best interest of the village and the community. As a result, we have appealed the judgment to the North Carolina court of appeals"


The decision is not a surprise for Village Manager David Lane, who predicted the Village would file an appeal.
