marvin_eric_tart.jpgCourt papers filed regarding the former Boone Police officer’s arrest have revealed new information.


According to the search warrant on 34-year-old Marvin Eric Tart’s residence, on July 28th, a State Bureau of Investigation detective posed as an 11-year-old female from the Asheville area.  An online conversation was initiated by a suspect with the detective posing as the 11-year-old.


The search warrant states the suspect said his name was Eric, and he had made plans to meet the girl at her residence shortly after 3:00 p.m.


At approximately 3:30 p.m., a Buncombe County Sheriff’s Deputy stopped a silver Infiniti vehicle, being driven by Tart, about 150 yards from the proposed girl’s address.


The deputy told Tart he had been stopped because the window tint on his vehicle was too dark, he had an expired inspection sticker, and his vehicle was displaying a license plate that was assigned to a Ford Bronco.


Tart was given a verbal warning and released.


The search warrant implies, according to these suspicious circumstances, a search warrant was requested for Tart’s residence.


The warrant was served on July 30th by the Watauga County Sheriff’s Department.  A digital camera, a laptop computer, a flash drive, 9 DVD’s, three DVDR’s, and house documents were seized from Tart’s residence.


According to the search warrant, Tart gave a statement to authorities where he admitted that he had viewed and downloaded child pornography, that the images would be located on the laptop that was seized, that he had been communicating with someone who he thought was an 11-year-old female, and that he had driven to the Asheville area with the intent to meet the 11-year-old.


According to the warrant for arrest, investigators have reason to believe Tart unlawfully, willfully, and feloniously photographed and duplicated material containing visual representations of nude, pre-pubescent females.


Some of these photographs included adults.


According to the arrest warrants, all of the offenses occurred this year.  The dates of the offenses were: April 21st, July 2nd, July 8th, and July 20th.


Tart was arrested and charged with six counts of second-degree sexual exploitation of a minor by the State Bureau of Investigation.


The investigation was spearheaded by the Buncombe County Sheriff’s Office and the North Carolina S.B.I.


Tart resigned from the Boone Police Department last Thursday and was placed under arrest on Friday.


Tart had been a member of the Boone Police Department since 1999.
