Burke Man Sentenced to 16 Years in Prison After Alford Plea in Statutory Rape Trial Print E-mail

clark.jpg A Burke County man was sentenced to 12 – 16 years in prison after entering an Alford Plea in a statutory rape trial.

According to our Foothills Bureau, 25-year-old Joshua Newton Clark entered the Alford Plea in a trial in which he was accused of the statutory rape of a 9-year-old girl.  An Alford Plea means Clark did not admit to being guilty, but believes that there is enough evidence against him for a conviction.

The alleged rape occurred in 2006.

The Morganton News-Herald reports after Clark is released from prison, he will be monitored by satellite for the rest of his natural life.

I hope the satellite monitoring will not be necessary. I hope he's gang raped to death in prison.

Statutory rape should not have been the charge. He was 22 at the time and she was 9?? That is NOT statutory! That is rape of a child. Period.

I actually had to look up statutory rape in case I had misunderstood the term. Nope. There has to be more to the story than this, because when a kid is 9 there's no mistake - it's rape, molestation of a child, whatever; NOT statutory rape.

What a scumball.

He will have major, major problems in prison.
A suggestion would be to notify Jessica Lunsford's advocacy group and/or her Dad and have them just look over the case, or another advocacy group for children to review the case.

Ali -The Hollywood crowd has come out in support of letting him (Polanski) off the hook. According to Whoopi on "The View" it depends on if it was "rape, rape" whatever the heck that means. It has been 30 years and the victim has moved on with her life he should be let go and let bygones be bygones.

Stephen - the plea that Clark took is just a technicality, he unfortunately does not have the money or connections to flee the country and live luxuriously for thirty years.

Statutory rape is one of those grey areas. But if these facts are true, him being 22 and she being 9, I don't think statutory rape is an appropriate charge. Rape or child molestation would have been much better.

Well Chambels, I don't agree with the Hollywood crowd at all. What Polanski did was disgusting.

Just to shed a little light, an Alford plea is very similar to a plea bargain, so he was probably initially charged with child molestation and had the charge reduced.
And I hope something as disgusting as the actions he carried out on that poor child happen to him twice as badly in prison.
