In a narrow 10 to 9 count, Senator Dan Soucek’s bill to strip Boone’s powers of extraterritorial jurisdiction survived its first vote on the House side of the State Legislature last night.  As one of a half dozen bills considered by the Committee on Rules, Calendar and Operations of the N.C. House of Representatives—and without the vote of local representative Jonathan Jordan—the bill moved along with the narrow vote.  The main concern of committee members was that the issue needs more study before taking the zoning power away from areas immediately adjacent to the Boone Town limits, in spite of Senator Soucek’s allegations before the committee that Boone has abused the use of the zone by regulating without planning to actually annex.  He called the situation for property owners “regulation without representation.”  The bill now goes on the House calendar pursuant to rules, which require a fiscal analysis to be attached to the bill within two days.
